The Ruling of Building Shrines and Mausoleums Upon The Graves
Evidence:
From Jaabir bin ‘Abdullah (ra) who said that the Messenger of Allah (saw) prohibited plastering of the graves and sitting upon it and building upon it.
From ‘Abu Al-Hayaaj Al-Asadiy who said ‘Ali Ibn Taalib (ra) said to me, “I am dispatching you upon what the Messenger dispatched me upon, that, “You do not leave statues except you deface it or nor a grave raised except you level it.”
He (saw) said “Do not take my grave as idol” “Do not take my grave as place often returning” “Allah’s most sever anger is upon a nation who took the graves of their Prophets as places of worship, i.e.(Masjids.)”
The Prohibition of Some Acts With Regards to Graves
The Messenger of Allah (saw) said, “Do not pray towards the graves and do not sit upon them.”
Insult and oppression on both the living and the dead is prohibited. Hence building roads, car parks, shops and other types of insult upon graves is prohibited.
Annual Visiting of Some Appointed Graves
1.) A Legislated visiting (Sharee’ah) only to 3 Masjids. (Masjid al-Haraam, Masjid al-Aqsa,
Masjid an-Nabawi)
2.) An innovated visiting (Bid’eeyah). Is when one does evil talk at the graves and seeks
aid from them instead of Allah.
3.) A visiting os Shirk (Shirkeeyah): Is when one supplicates to them, or sacrifices to them or
vows by them, as opposed to Allah.
The Prohibition of Harming the Muslims
Ibn ‘Umar (ra) said, The Messenger (saw) ascended the minbar and called out with a loud voice and said, “Oh gathering, who submit with your tongue, and emaan has not entered your hearts, do not harm the Muslims, do not insult them and do not pursue their mistakes. For verily the one who pursues the mistakes of his Muslim brother, then Allah will pursue his mistakes and whoever’s mistakes are pursued by Allah then He will expose him even if he was on the inside of his camel’s saddle.”
